Nortel, once one of the biggest telecoms company in the world but now in the death throes of bankruptcy, has selected Google's $900 million bid for its patent portfolio as the stalking horse bid. This doesn't mean that Google will automatically win Nortel's massive array of telecoms patents, but it does mean that Google is the preferred buyer.

Google, which has a history of lobbying for patent law reform, has been the target of many patent litigation suits. Google's relative infancy means that it has a lot less patents in the vault than big-hitters like Microsoft, Oracle and IBM, and buying Nortel's portfolio of 6,000 patents could provide better protection against patent litigation in the future. It's worth noting that both Apple and RIM have showed interested in the portfolio, too.

Mashable speculates that the patents -- which are nearly all telecoms-related -- will be used to defend against Oracle's attacks on Android's use of Java. We reckon that Google is simply looking to cover its future endeavors in the world of networking. In the absence of patent law reform, and continued threats to net neutrality, owning a bunch of telecoms patents sounds like a very sensible move.

Konstruct generative augmented reality art for iOS
If you have an artistic temperament, but you weren't blessed with steady hands or an eye for color, Konstruct might be the app for you. Not only does the iPhone app let you produce generative art using words, warbles and whistles, but it also uses augmented reality to bring your artistic creation to life.

To get started, you first need to print out the Konstruct marker and place it wherever you'd like to create your AR sculpture -- it could be on your living room wall, or on the floor of your bathroom, it doesn't matter. Open the app, point your iPhone at the marker, and start making some noises! Once you're done, you can save your creation, or simply wipe the slate clean and start again.

The volume of your voice affects the size of the shapes that are drawn on the screen, and you can move your head around to alter the path of your 'brush' -- but to change the shape of your brush or modify the color palette you have to use a menu. Without knowledge of the app's internal workings, it's hard to say what the actual difference between whistling, talking and singing is -- and judging by the developer's affinity for whistling in the demo video (after the break), the app probably doesn't perform that much analysis on your input.

Still, Konstruct is just a prototype! A later version could do away with menus and rely entirely on the location, tonality, quality and amplitude of your voice -- and judging by the the words of the developer, James Alliban, there is definitely more in store for Konstruct: "The idea of transforming entire cities into user generated virtual art galleries really appeals to me. I see Konstruct as an early prototype that will hopefully be realised in this form in the future."

There's a war on unlimited data being fought as we speak, and Ma Bell is leading the main charge. Just days after AT&T announced it would begin throttling data speeds for the heaviest bandwidth hogs grandfathered into the carrier's no-limit internet service, it's also confirmed it's ready to crack the whip on illegal tethering as well. In attempt to achieve "fairness for all of [its] customers," the carrier has added a bit of force behind its March announcement, sending out notices to anyone using their jailbroken iPhones as a mobile hotspot. The gist? Cut it out or be scaled back to a tiered data plan. In a statement originally given to 9to5mac, an AT&T spokesperson said:
Earlier this year, we began sending letters, emails, and text messages to a small number of smartphone customers who use their devices for tethering but aren't on our required tethering plan. Our goal here is fairness for all of our customers. (This impacts a only small percentage of our smartphone customer base.)

The letters outline three choices:

1. Stop tethering and keep their current plan (including grandfathered unlimited plan)
2. Proactively call AT&T or visit our stores and move to the required tethering plan 3. Do nothing and we'll go ahead and add the tethering plan on their behalf - after the dated noted in their customer notification
We reached out to AT&T and confirmed that this statement is indeed true. Consider this the company's last warning -- your time to enjoy all-you-can-eat tethering is almost at an end. How soon the day of reckoning will come, however, likely depends on when you received the notification originally. And you thought you were being so sneaky...

T-Mobile USA issued its Q2 earnings statement today and, while the outlook isn't quite as bleak as it was during the first quarter of this year, there's still some cause for concern up in Bellevue. According to the report, the carrier lost a total of 50,000 customers last quarter, which is actually an encouraging sign, considering it dropped a whopping 99,000 during Q1, and 93,000 during the second quarter of 2010. Total revenues, however, dipped slightly to $5.1 billion from the $5.2 billion reported for the previous quarter, with service revenues holding firm at $4.6 billion -- a 1.7 percent decrease from Q2 2010. President and CEO Philipp Humm blamed the numbers on a "challenging market," but was quick to point out the brighter aspects of T-Mobile's statement, including the carrier's expanded 4G coverage, and the fact that a full 29 percent of its customers are using 3G or 4G smartphones -- an "all-time high." With Windows 8 milestone 3 now up for grabs for select Microsoft Connect partners, it's inevitable that leaked bits and pieces will start popping up around the Web. In fact, the first "official" wallpaper image from the still-brewing OS is already making the rounds.

As you can see, it's got a similar feel to the good ol' Windows 7 default background, but features a more subdued smattering of cerulean hues. Those of you who want to use the Windows 8 wallpaper on your current desktop can download it from our file dump.

A few other details have been revealed, too. According to ZDNet's source, the Windows 8 Jupiter libraries and Twin UI are starting to take shape -- though all that's been located thus far are "[various files] scattered throughout the OS" and the aptly-named twinui.dll.

If you used Windows XP for a long time (who didn't?), one of the biggest changes when moving to Windows 7 or Vista was the massively-altered Explorer. While the new Explorer introduces some useful new features, it also removed just as many -- which is where Classic Shell comes in!

We've covered Classic Shell before, but here's the crib note: Classic Shell restores almost every Windows XP-era Explorer feature. The best change, in our opinion, is the reemergence of the 'up' arrow, meaning you now navigate without using the Windows Vista/7 'breadcrumbs' address bar. The status bar yet again shows the total size of your selection, and -- praise be! -- the diabolical Windows 7 Copy File 'copy and replace?' dialog has been replaced with a Windows XP lookalike (image after the break).

New to the most recent version of Classic Shell is the ability to make IE9 look like IE8. With Classic Shell the title bar yet again has a caption, so you can see the full title of Web pages. The current security zone and loading progress indicator have been put back into the status bar, too. If you enable 'Show tabs on a separate row,' it's almost like using IE8.

Finally, Classic Shell replaces the omnipotent Windows 7 Start Menu with the age-old 'classic' Windows 2000/XP-style Start Menu. Classic Shell makes the Start Menu skinable, too, if you're into the kind of thing.

As awesome as it sounds, we've only touched on a small section of Classic Shell's feature set. Check the Classic Shell site for a complete list. There's a few more images of Classic Shell in action after the break.

Firefox 4 racks up 25 million downloads in 3 days
If you've had your head under a rock for the last few days, here's this week's Firefox news in brief: Firefox 4 was finally released.

Yes, 13 months after the initial release of Firefox 3.7 alpha 1 and four more alpha builds, a renumbering to 4.0 and 12 beta releases, and finally a release candidate (or two), Firefox 4 has been released into the wild.

Just like every other Firefox release, initial reception for the new browser has been nothing short of insane. 7.1 million downloads were registered in the first 24 hours and the download rate continued to accelerate, clocking in more than 15 million downloads after two days. At the time of writing, three days in, Firefox 4 has been downloaded over 25 million times. In case you're wondering, the United States accounts for 7 million of those downloads, just beating out Germany's Firefox-downloads-per-capita.

But now that you've installed Firefox 4 (you have, right?), what do you do now? Well, obviously, in true Download Squad fashion, it's time to tweak Firefox 4 using add-ons and about:config hacks!

Sand Trap
Sand Trap is one of those games that at first seem too hard to bother with, but when you try to stop playing it you discover you're hooked.

The goal is to get as much sand as you possibly can out of the maze and into the bucket at the bottom of the screen. You need to rotate your maze every which way to get the sand rolling around it. You then try to direct the sand to one of the exits of the maze, and hopefully into the bucket. It took me several tries to actually get sand into the bucket, but that might be due to the fact that I didn't even realize the bucket was there at first. Things improved significantly after that.

As you level up, the mazes get more complicated, with moving parts and other things making your life more difficult. Once you manage to get through all these obstacles and get enough sand into your bucket, you can move on.

As I mentioned, this is not an easy game, but it's highly addictive. The graphics remind me of some long lost game from the 80s, but this just proves that you don't need super graphics and crazy sound to make a game work. There's a soothing guitar track playing in the background and that's it, as far as I could hear, and you can enjoy it just as much with no sound at all.
